Terms and Conditions

           I.    Introduction

  1. Welcome to our Website (hereinafter the "Website"), owned and operated by UAB FIDUS ARS (hereinafter “seller”, “we”, “us”, or “our”). By accessing our Website, you agree to the following Terms and Conditions (hereinafter the "Terms"). These Terms and Conditions are effective as of March 1, 2024.

These Terms are a mandatory legal document which establishes the rights and commitments between us and Customer (hereinafter “buyer”, “you”, “your”, “customer”, “client”) including terms of order and payment for the products (hereinafter “goods”, “item”,” purchase”) policy, privacy policy, shipping policy, cancellation and returns policy, warranty policy, responsibilities and liabilities of the parties and other regulations related to buying products in the Website.
  3. You accept the Website "as-is" and choose to use it at your own risk and for general information only.
  4. We reserve the right to update, modify, or change these policies, terms, and conditions at any time and without prior notice. It is the user’s responsibility to periodically review these Terms and Conditions to be aware of any changes.

Except as otherwise provided on the Website or in these Terms, you may not use, download, upload, copy, display, reproduce, publish, modify, delete, add to, license, post, transmit, or distribute any materials and content from this Website, in whole or in part, for any public or commercial purpose without the specific prior written permission of UAB FIDUS ARS.
  3. By submitting product review, you should be aware that any information you provide in review form may be published on a Website and may be read, collected, and used by Website. Therefore, please do not include any information within these areas that you do not want to share with the general public, including personally identifiable information, such as your full name, email address or financial information.

  1. We do our best in order to ensure that information on Website is accurate, complete and current, but despite of our efforts, information on Website may be inaccurate, incomplete or out of date.
  2. Although we have made every effort to photograph and display the products and their colors as accurately as possible, actual colors may differ from displayed on the Website.
  3. All products, specifications, descriptions, prices and other information on Website is subject to change at any time without notice.

           VI.      Pricing terms

  1. Product prices are indicated in three currencies: EUR (euro), USD (United States dollar) and GBP (Great Britain pound). If customer makes purchase in USD or GBP, such purchase transaction will be converted to EUR by customers payment institution automatically. Your payment institution can charge you a conversion fee (up to 3% usually).
  2. Product prices will be listed at the time of purchase, which may vary by country.
  3. EU based customers will pay price with value added tax specific to his country’s VAT rate (Inc. VAT price). Correct VAT rate will be applied once customer chooses delivery country.
  4. UK based customers will pay price depending on product’s location. We will contact UK based client individually every time.
  5. Rest of world clients will pay prices without taxes (Ex. VAT). All non-EU based customers may be subject to import duties and taxes before delivery and these costs are NOT included in product or shipping price. All custom clearance procedures with all associated charges and processing fees are customer’s liability.
  6. Shipping costs and options are specific to every product. Customer must use delivery country and post code in order to see final price.
  7. Pricing and availability may change without notice.

       VII.    Ordering and Payment terms

  1. The price and availability of any product or service are subject to change without notice.
  2. We do not process payments ourselves and do not collect or store your credit card information. We use worldwide payment processing service providers (hereinafter "Payment processor(s)"):
    • Stripe for:
      • Credit / Debit Card.
      • Bancontact.
      • EPS.
      • Giropay.
      • Google Pay.
      • iDeal.
      • SEPA.
      • Sofort.
    • PayPal for PayPal Express Checkout
    • EU based and licensed bank institutions for offline payment methods, such as bank transfers.
  3. Payment method availability depends on country.
  4. Please note that your use of the Payment processor's services may be subject to Your acceptance of such Payment processor's own Terms and Conditions, which can be found below:
  5. You are liable for complying with any applicable Terms and Conditions, whether with us or Payment processor's, which apply to the use of your selected payment processing method.
  6. For each purchase, you confirm that you are authorized to use the form of payment provided to Website and that any payment information that you provide is accurate.
  7. We may add, remove, or change payment processing methods without notice.
  8. Customers’ authorized payments are not accepted by Website automatically once you confirm payment. You authorize us to capture payment only.
  9. We verify each order individually. Once order verification is completed, we capture your payment manually. Order is accepted if payment is capture only.
  10. Upon receiving an online order for any compatibility specific goods, customer support will contact the customer via email (at the email address indicated by the customer) and/or by telephone to confirm the purchase. We do that due to specific of product and avoid of any misunderstanding.
  11. Customer is liable for correct and accurate information, required for compatibility check. Refuse to give any required information is reason for order cancellation.

      VIII.    Shipping policy

  1. All standard orders are dispatched within 24-48 hours on working days after payment is being captured.
  2. We use post services and worldwide carriers (DHL, TNT, FEDEX) to ship out items worldwide. We also include regional delivery companies (DPD, GLS and other) for items delivery in EU.
  3. Shipping to EU and US is FREE in most cases, but it’s worth to check shipping calculator on shopping cart always.
  4. We can deliver to PO boxes only items using post services with value up to 150 EUR / $160 / £130. If customer has specific demand on delivery, he should contact us before order.
  5. Standard delivery time is 5 business days for EU, 10 - 14 business day for US, and 20 working days for rest of world. Delivery times are NOT guaranteed.
  6. Shipping availability to specific country and shipping price with possible shipping options for any item can be checked using country selector with correct post code in shopping cart.
  7. Customers outside the EU may be subject to import duties and taxes before delivery and they are NOT included in product or shipping price. All custom clearance procedures with all associated charges and processing fees are customer’s liability. If customer refuses to accept the shipment because this reason, customs authorities or carriers may charge us an administration fee, and this fee will be deducted from the customer’s payment amount before refund.
  8. Customer must check package for visible external damages before accepting package from courier. If such damages are identified, it is customer’s liability to make a note about damages on courier’s form of package acceptation.
  9. If customer receives a damaged package or item, he must contact us immediately. Customer must retain ALL shipping packages for inspection by the delivery company. Failure to keep damaged boxes can result in any and all damage claims being denied. Some delivery companies demand official claim from sender and recipient. Customer, as recipient must cooperate in such cases.

10.We do not ship COD orders.

11.If buyer has time sensitive orders, he should contact us before making order.

12.Weekend / holiday orders will be started to process the next business day.

13.We reserve right to change shipping policy without notice.

        IX.    Return and cancellation policy

  1. We are always sad to hear that product has not meet customer’s expectations. Customer can return almost any* item and we will be happy to accept such return within 14 days of actual delivery date under following conditions:
    • To be eligible for a return, item must be unused and in the same condition that you received it from us in original, unmarked, and undamaged packaging.
    • If product has original specific packaging with tamper security seals / labels which are being damaged when opening, such product can be returned if packaging and seals are intact.
    • Customer is liable for return shipping costs.
    • If customer has chosen other than free shipping method on order, such original shipping costs are not eligible for refund on case of return.
    • If customer received wrong product or other mistake was made by our side, we will be happy to cover return costs as well.
  2. *Following items are not eligible for returns:
    • Individually ordered items according buyer’s specific requirements.
    • Items with custom modifications fulfilled according agreement with customer.
    • Safety related parts, such as airbags, seat belts, sensors for safety systems.
    • Items with damaged security labels on packaging. If genuine packaging has such labels, item can be return if packaging was not opened only.
    • Items with damaged warranty seals.
  3. Return procedure
    • Arrange for a return by contacting us via our live chat feature, contact us or emailing us.
    • Get return authorization number and instructions for return shipping (if item is eligible for return according conditions stated above). Sometimes we may ask to use or NOT use specific courier for return shipping.
    • Pack product properly and send it back. Buyer is liable for parcel integrity during return shipping process.
    • Receive your refund. Once we receive item, we will inspect it and immediately notify you on the status of your refund. In case your return is approved, we will initiate a refund to original method of payment. You will receive the credit within a certain amount of days, depending on your bank’s policies.

         X.    Cancellation policy

  1. We reserve right to cancel transaction at any time.
  2. The buyer has right to cancel order anytime within 14 days of actual delivery date.
  3. We encourage you to contact us regarding cancellation anytime, especially before actual dispatch of product to you. If purchase is not dispatched, you will get refund in original payment ‘s method within a certain number of days, depending on your bank’s policies.
  4. In case purchase is sent, you will have to wait its delivery and proceed with return procedure as described.

        XI.    Warranty terms

  1. This warranty terms applies to products, bought on the Website. The warranty scheme therefore only applies in a B2C (business to customer) context.
  2. The warranty period starts and is valid from the day of delivery of the goods.
  3. Warranty covers non-performance or defective performance of product.
  4. Warranty covers product purchased from Website only. Any other parts or labour costs required because replacement of warranty covered product is buyer’s liability.
  5. If product has issues and is covered by warranty terms, it will be:
    • Repaired (if possible) as first option.
    • Replaced as second option.
    • Accepted as return.
  6. Warranty period is specific to different regions due to different legal requirements:
    • EU based customers:
      • Products listed as new have 24 months warranty.
      • Products listed as new (other) have 12 months warranty. Such product may be without original packing, may have some minor visual damages which does not affect functionality in any means. These products are discounted comparing to new products in original packing.
      • Products listed as “used” have 12 months warranty.
    • UK based customers:
      • Products listed as new have 24 months warranty.
      • Products listed as new (other) have 12 months warranty. Such product may be without original packing, may have some minor visual damages which does not affect functionality in any means. These products are discounted comparing to new products in original packing.
      • Products listed as “used” have 90 days warranty.

    • US based customers:
      • Products listed as new have 24 months warranty.
      • Products listed as new (other) have 12 months warranty. Such product may be without original packing, may have some minor visual damages which does not affect functionality in any means. These products are discounted comparing to new products in original packing.
      • Products listed as “used” have 90 days warranty.
    • Rest of World:
      • Products listed as new have 12 months warranty.
      • Products listed as new (other) have 6 months warranty. Such product may be without original packing, may have some minor visual damages which does not affect functionality in any means. These products are discounted comparing to new products in original packing.
      • Products listed as “used” have 30 days warranty.
  7. Warranty covering the product is not valid if damage is caused by the owner/user. Such cases are for example corrosion due to the ingress of liquid or moisture into the device, external impact, unauthorized intervention in the device, damages due to improper installation, etc.
  8. Due to specific of products, visual and cosmetic defects, caused by buyer and which do not affect functioning of product, is are not eligible as warranty case.
  9. To obtain warranty service, buyer musts first contact us to determine the problem and the most appropriate solution for you.
  10. Buyer is liable for shipping costs of product back to us in case for required return to inspect and / or replace product.

       XII.    Limitation of Liability

  1. We are not liable for any direct, indirect, incidental, special, or consequential damages that may result from the use, misuse or inability to use our Website or products bought on Website.
  2. Website provides products and information on these products only. Installation or any other associated risks and costs are buyer’s liability. Buyer has to evaluate his competence to install and maintain and use product in any means before purchase.
  3. We do not guarantee that Website is free of errors, or that access to it will be uninterrupted.

      XIII.    Applicable Law and Jurisdiction

  1. These Terms and Conditions together with any transaction between us and buyer will be governed and interpreted in accordance with the laws of Lithuania, without giving effect to any provisions on conflict of laws.
  2. Any dispute arising in connection with these policies, terms, and conditions will be exclusively resolved in the courts of Kaunas, Lithuania.
